Waterways and communities
Like Brookhaven, Oyster Bay has frontage on both coasts. On the South Shore, the Massapequa canals and lagoons (Grand Lagoon, the Biltmore Shores and Nassau Shores canals) open onto South Oyster Bay. On the North Shore, Bayville, Mill Neck, Centre Island and the hamlet of Oyster Bay face Oyster Bay Harbor, Mill Neck Creek and Long Island Sound, where open water and wave exposure call for heavier walls and deeper pilings than a sheltered canal.

Local permits in Oyster Bay
Town permit: Chapter 241, Article II
Any mooring, dock, pier, float, bulkhead or similar structure built or modified in Town waterways needs a Town permit. Applications go to the Department of Planning and Development, which rules on structural soundness and on electrical and plumbing questions.
- The application includes a short environmental assessment form and fees, plus copies of everything filed with NYSDEC, the Army Corps of Engineers and the NYS Department of State (coastal consistency).
- It also needs a survey with plans and specifications (including any electric and water service), and a radius map of the structures on the two properties on each side of yours and on any waterfront property directly opposite. Add a chart of mean low tide within 300 feet.
- You must certify that you mailed a copy of the application to those neighboring owners. The Commissioner considers their comments.
- If the structure stays within your property line (including riparian rights), the Commissioner decides. If it goes beyond, the Town Board decides by resolution after at least 14 days' written notice to those neighbors.

Villages: In incorporated villages (Massapequa Park, Bayville, Centre Island, Mill Neck, Oyster Bay Cove and others), the village issues the permit. The Town's Department of Planning and Development first checks whether the structure reaches past village limits into Town waters, and if it does, the Town Board has to approve it.
State layer: most replacements here can use DEC's bulkhead general permit (in place or landward, up to 18 in. higher, no application fee) unless the site is near vegetated tidal wetlands or eelgrass or in an erosion hazard area. Check if you qualify.
Flooding and wall height in Oyster Bay
The Massapequa canals are low-lying, and the Town itself files DEC applications to dredge canals there to restore navigation (for example, about 3,940 cubic yards from Canal #1 in 2025). If your canal is scheduled for Town dredging, ask your contractor how it affects the wall's toe and the timing of your own work.
What drives the price in Oyster Bay
Expect the paperwork to be part of the price: the radius map, low-tide chart and neighbor mailings take surveyor and consultant time. North Shore jobs on open water often call for steel or heavier vinyl and longer piles than a sheltered Massapequa canal. One 2025 DEC filing in Massapequa's Grand Lagoon combined a bulkhead replacement on a new alignment with a platform, ramp, a 5×30-ft floating dock and a 4-pile boat lift. Bundling the work into one permit is common.

Oyster Bay bulkhead & dock FAQ
Do my neighbors get notified about my bulkhead permit?
Yes. Chapter 241 requires you to mail a copy of the application to the owners of the two properties on each side and any waterfront property directly opposite, and to certify that you did. Their comments are considered.
I live in Massapequa Park or Bayville. Who issues my permit?
The village does. The Town only reviews the plans to check whether the structure reaches into Town waters beyond the village limits, and if it does, the Town Board must approve it first.
Can I add a floating dock and a boat lift at the same time?
Usually you can apply for them together, and DEC filings in Massapequa often do. Each structure is reviewed, so bundling saves paperwork, not review.
